1. Acceptance of Terms
By downloading, installing, or using Voyara ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Voyara ("we," "us," or "our").
2. Description of Service
Voyara is a travel itinerary planning application for Apple devices (iPhone, iPad, Apple Watch, and Mac). The App allows you to organize trips, import travel confirmations, view weather and currency information, manage packing lists and expenses, and store travel documents.
3. Eligibility
You must be at least 13 years of age to use Voyara. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. Subscriptions and Pricing
4.1 Subscription Plans. Voyara offers the following subscription options:
- Monthly Subscription: Billed monthly at the price displayed at the time of purchase.
- Yearly Subscription: Billed annually at the price displayed at the time of purchase.
- Lifetime Purchase: A one-time purchase granting access to all premium features indefinitely.
4.2 Free Trial. We may offer a 7-day free trial for new subscribers. During the free trial, you will have full access to all premium features. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate.
4.3 Auto-Renewal. Monthly and yearly subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
4.4 Cancellation. You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No refunds are provided for partial billing periods.
4.5 Price Changes. We reserve the right to change subscription prices. Any price changes will take effect at the start of the next billing period following notice to you. Your continued use of the App after a price change constitutes acceptance of the new price.
Note: All payments are processed by Apple through the App Store. We do not directly collect or store any payment information. All billing inquiries should be directed to Apple Support or managed through your Apple ID settings.
5. Free Features
Voyara offers certain features at no cost. We reserve the right to modify which features are included in the free tier at any time, with reasonable notice to users.
6. Acceptable Use
You agree to use Voyara only for its intended purpose as a personal travel planning tool. You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App.
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to the App's systems, servers, or networks.
- Distribute, sublicense, lease, or otherwise transfer the App or your subscription to any third party.
- Use the App to store or transmit malicious code, harmful content, or illegal materials.
- Interfere with or disrupt the integrity or performance of the App or its related systems.
- Use automated means (bots, scrapers, etc.) to access or interact with the App.
7. Intellectual Property
7.1 Our Intellectual Property. The App, including its design, code, graphics, interface, content, and trademarks, is owned by Voyara and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use Voyara's name, logo, or trademarks.
7.2 Your Content. You retain all rights to the content you create or import into Voyara, including your travel itineraries, documents, notes, and other personal data. By using the App, you grant us no rights to your content. Your data is stored on your device and in your private iCloud container, and we do not access it.
8. Disclaimer of Warranties
Voyara is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will be uninterrupted, timely, secure, or error-free.
- Travel information displayed in the App (including weather forecasts, currency rates, or time zones) will be accurate or complete.
- The App will be compatible with all devices or operating system versions.
- Any data parsed from emails, boarding passes, or other sources will be entirely accurate.
Important: Voyara is a planning and organization tool. Always verify critical travel details (flight times, booking references, visa requirements, etc.) directly with your airlines, hotels, and travel providers.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Voyara, its developers, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to:
- Your use of or inability to use the App.
- Any inaccuracy in travel data, weather information, currency conversions, or parsed content.
- Missed flights, bookings, or travel arrangements due to reliance on the App.
- Unauthorized access to your data due to circumstances beyond our reasonable control.
- Any third-party services accessed through or in connection with the App.
In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Voyara and its developers, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable laws.
11. Third-Party Services
Voyara integrates with Apple services (WeatherKit, CloudKit, MapKit, StoreKit) and may display information from third-party sources. We are not responsible for the accuracy, availability, or content of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
12. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 7, 8, 9, 10, and 14.
You may terminate your use of the App at any time by uninstalling it from your devices and canceling any active subscriptions through your Apple ID settings.
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by updating the effective date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Voyara regarding your use of the App and supersede all prior agreements and understandings.
